By accessing our website, placing an order, or subscribing to any subscription plan, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree with these Terms, please do not use our website or purchase our products.

About 59 Seconds 59 Seconds is a wellness and nutraceutical brand operated by Torque & Tonic Group (“59 Seconds”, “we”, “us”, or “our”). We offer wellness products intended to complement a healthy lifestyle. Our products are not intended to diagnose, treat, cure, or prevent any disease unless expressly permitted under applicable law and applicable product regulations.

Eligibility By using our website or purchasing our products, you confirm that: • You are at least 18 years of age. • You have the legal capacity to enter into a binding agreement. • The information provided by you during checkout is accurate and complete. • You are purchasing products for personal use and not for any unlawful purpose. 

 Products & Product Information We make reasonable efforts to ensure that product descriptions, ingredient information, images, specifications, prices, and other information displayed on our website are accurate and up to date. Orders & Order Acceptance When you place an order through our website, you are making an offer to purchase the selected product(s) at the displayed price. An order confirmation may acknowledge that we have received your order but does not necessarily constitute final acceptance of the order. We reserve the right to refuse, cancel, or limit an order in circumstances including: • Product unavailability • Pricing or listing errors • Suspected fraudulent or unauthorised activity • Payment issues • Incorrect customer information • Delivery limitations • Violation of these Terms If we cancel an order after payment has been received, the eligible amount will be refunded to the original payment method or through another appropriate refund mechanism.

One-Time Purchases Customers may purchase products through a one-time purchase option where available. A one-time purchase does not automatically renew. You will be charged for the order amount displayed at checkout, together with any applicable shipping or other charges clearly communicated before payment. Once the order has been successfully placed and accepted, it will be processed for fulfilment according to our applicable shipping timelines. 

 Subscription Program 59 Seconds may offer subscription plans that allow customers to receive products on a recurring basis. By selecting a subscription plan, you authorise us and/or our authorised payment service provider to charge the applicable subscription amount according to the billing schedule presented to you at the time of purchase.
7.1 Subscription Billing The subscription price, billing frequency, product quantity, and applicable benefits will be displayed during checkout. Unless otherwise stated: • Your subscription will automatically renew at the applicable interval.
• The applicable subscription amount will be charged for each renewal.
• Your subscription will continue until cancelled in accordance with these Terms.
• Taxes and shipping charges, where applicable, will be disclosed at checkout. 

7.2 Subscription Cancellation You may cancel your subscription before the next scheduled billing or order-processing date through the cancellation mechanism provided by 59 Seconds. Cancellation will generally prevent future subscription orders from being generated or charged. Cancellation does not automatically cancel an order that has already been successfully processed, packed, shipped, or otherwise committed for fulfilment.

7.3 Subscription Changes Where supported, customers may be able to modify their subscription, including applicable delivery frequency, quantity, or other available options. Any changes will apply from the next eligible billing or fulfilment cycle and will not necessarily affect an order that has already been processed.
7.4 Failed Subscription Payments If a scheduled subscription payment fails, we or our authorised payment provider may attempt to process the payment again. If payment cannot be successfully completed, we may pause, delay, or cancel the affected subscription order. You are responsible for maintaining valid payment information and ensuring that sufficient funds or credit are available for scheduled payments.
7.5 Subscription Pricing Changes We reserve the right to change subscription pricing in the future. Where required by applicable law, customers will receive appropriate notice of material pricing changes before the revised price applies to a future renewal.

8. Subscription Promotions & Complimentary Items Certain subscription plans may include promotional benefits, discounts, complimentary products, accessories, or other benefits. The eligibility and duration of such benefits will be specified at the time of purchase. Unless expressly stated otherwise, promotional benefits are linked to the applicable subscription plan and may not be exchangeable for cash. If a subscription is cancelled, refunded, or terminated before completion of any stated minimum promotional period, 59 Seconds may, where legally permissible and clearly disclosed at the time of purchase, adjust or recover promotional benefits associated with the subscription. 

9. Pricing & Taxes All prices displayed on our website are in Indian Rupees (INR). Applicable taxes will be included in or added to the displayed price as required by applicable law and will be communicated at checkout. Prices may change from time to time. Any price change will not affect an order that has already been successfully accepted and paid for, except where required to correct an obvious pricing or technical error.

11. Shipping & Delivery Orders will be shipped to the delivery address provided by the customer during checkout. Delivery timelines displayed on our website are estimates and may vary because of circumstances outside our reasonable control, including courier delays, weather conditions, public holidays, natural events, operational disruptions, incorrect or incomplete delivery information, and other logistical circumstances. Once an order has been handed over to the delivery partner, delivery may also be subject to the courier's operational timelines. Customers are responsible for providing an accurate delivery address and contact information.

 12. Incorrect, Damaged or Missing Products If you receive a product that is damaged, incorrect, defective, or materially different from what you ordered, please contact our customer support within the timeframe specified in our Refund & Return Policy. We may request photographs, videos, order details, packaging information, or other reasonable evidence to investigate the issue. Where the claim is verified, we may provide an appropriate remedy, which may include replacement, refund, or another solution permitted under applicable law.

13. Returns, Refunds & Cancellations Returns, refunds, replacements, and order cancellations are governed by our Refund & Return Policy, which forms part of these Terms. Because our products may include consumable wellness products, certain products may not be eligible for return once opened or used, subject to applicable law. Customers should review our Refund & Return Policy before placing an order.

Intellectual All intellectual property appearing on the 59 Seconds website, including brand names, logos, product names, text, product descriptions, photographs, graphics, videos, designs, website layouts, packaging designs, and marketing materials is owned by or licensed to 59 Seconds / Torque & Tonic Group and is protected under applicable intellectual property laws. You may not reproduce, copy, distribute, modify, publish, sell, or commercially exploit our intellectual property without prior written permission.

Website Use You agree not to use our website for unlawful purposes; attempt to gain unauthorised access to our systems; interfere with the operation or security of the website; upload malicious software or harmful code; misuse our website, payment systems, or promotional offers; impersonate another person or provide fraudulent information; or violate the intellectual property rights of 59 Seconds or any third party. We reserve the right to restrict or terminate access to the website where we reasonably believe these Terms have been violated.

Force Majeure 59 Seconds shall not be responsible for delays or failure to perform obligations caused by circumstances beyond our reasonable control, including natural disasters, government actions, strikes, civil disturbances, pandemics, transportation disruptions, technology failures, or other events that could not reasonably have been prevented.

If a dispute cannot be resolved amicably, it shall be subject to the jurisdiction of the courts having appropriate jurisdiction over the matter and the location of the business, subject to applicable law.

22. Severability If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be modified or removed to the minimum extent necessary, while the remaining provisions shall continue to remain in effect.
